No need for MLA-elect to engage in ‘direct action’ against meat sellers
Steer clear of disturbing public peace by attacking dietary practices
The newly elected MLA from Hawa Mahal, Bal Mukundacharya, has not even been sworn into office yet and he has already issued threats to meat sellers who he claims operate “illegally”. A video of his instructions to police to shut down non-vegetarian eateries in the Chandi Ki Taksal area surfaced on the internet soon after the assembly election results were declared on December 3. “Can meat be sold in the open on the road? Answer is yes or no? Are you endorsing them? I will take a report in the evening,” he is heard saying on the phone. Speaking to a restaurant owner, he demands to know whether he holds a licence, and whether he wishes to transform the area into Karachi.
People’s Union for Civil Liberties condemns the threats issued by the MLA-elect, even before he has sworn his allegiance to the Constitution of India and taken office. No legal procedures were followed, and street-side hawkers and enterprises run by members of the minority community were threatened. There is a Street Vendors (protection of livelihood and regulation of street vending) Act, 2014, under which there is no discrimination based on whether the food items sold are vegetarian or non-vegetarian. Vending zones were supposed to be created, under the law, and town vending committees are expected to provide security to street vendors. These committees have not yet demarcated vending zones and provided licences to vendors.
While these procedures are still pending, PUCL condemns the action of the MLA-elect in taking the law into his own hands and threatening vendors. He has discriminated against people in his own constituency and declared publicly that he has little regard for the law of the land.
There has historically been great diversity in the manner of dress, choice of diet and lifestyle of the people of Rajasthan; these differences have not caused disharmony, and are part of the rich tradition of the state. PUCL declares that it expects the representatives of the people to show greater respect for diversity and communal amity. PUCL demands that newly elected MLAs act in accordance with the Constitution of India, and not in accordance with their individual whims.

लोगों के खाने और डाइटरी प्रैक्टिसेज पर हमला गैर संविधानिक
जयपुर- 4 दिसम्बर 23-हवामहल के नव निर्वाचित विधायक बाल मकुंदाचार्य द्वारा जयपुर शहर में फुटपाथ और दुकानों में नॉनवेज बेचे जाने के ख़िलाफ़ बिना क़ानूनी प्रक्रिया अपनाये डायरेक्ट एक्शन करने की कड़ी निंदा करते हुये इसे अल्पसंख्यक व्यवसायको विरोधी व पथ विक्रेता क़ानून का खुला उल्लंघन बताया है.
मानव अधिकार संगठन पीयूसीएल ने प्रेस बयान जारी कर कहा कि पथ विक्रेता क़ानून में वेज और नॉनवेज का कोई ज़िक्र नहीं है, वेण्डिंग ज़ोन बनाए जाने तथा टाउन वेण्डिंग कमेटी गठित करके पथ विक्रेताओं को सुरक्षा देने का नियम है, अभी तक टाउन वेंडिंग कमिटी ने वेंडर्स को लाइसेंस नहीं दिए हैं और वेंडिंग जोन्स भी चिन्हित नही किए हैं, ऐसे में एक नव निर्वाचित विधायक क़ानून हाथ में लेकर मीट की दुकानों तथा रेहड़ी पटरी पर नॉन वेज बेचने वालों को धमकाना अत्यंत चिंताजनक बात है. इसका हम पुरजोर शब्दों में निंदा करते हैं l
नव निर्वाचित विधायक जिन्होंने अभी शपथ भी नहीं ली है, वे अपने ही क्षेत्र के नागरिकों के साथ इस तरह भेदभावपूर्ण व्यवहार करते हुए धमकाने में लग गये हैं, जो कि भारतीय संविधान की मूल भावना के विरुद्ध कृत्य है. विधायक को इस तरह की कार्यवाही तुरंत रोकनी चाहिये.
पीयूसीएल ने लोगों के खान पान की अभिरुचियों के सांस्कृतिक अधिकार (थे राइट टू माय चॉइस ऑफ डाइटरी प्रैक्टिसेज) पर इसे हमला करार देते हुए कहा है कि राजस्थान जैसे प्रदेश में लोगों के खाने,पहनने और जीवन जीने के तरीक़ों में विविधता है और इसे लेकर कभी भी कोई संघर्ष नहीं रहा है,ऐसे में नागरिकों के भोजन की आदतों में हस्तक्षेप ग़लत परंपरा की शुरुआत है, राजस्थान की आने वाली नई सरकार को नागरिक अधिकारों की सुरक्षा की अपेक्षा की जाती है, न कि उसके विधायक से बिना कोई प्रक्रिया अपनाए सीधी कार्यवाही की अपेक्षा की जाती है.
